ORDINANCE NO. BL2009-537

An Ordinance amending Chapters 17.04 and 17.08 of Title 17 of the Metropolitan Code, Zoning Regulations, to allow artisan distilleries as a permitted use in the commercial core, core frame and industrial zoning districts, and to make a technical change to the land use tables pertaining to microbreweries (Proposal No. 2009Z-036TX-001).

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 17.04.060 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, is hereby amended by adding the following new definition:

“Artisan distillery” means the production of alcoholic beverages in quantities not to exceed one thousand (1,000) barrels per month, with a barrel containing not more than fifty-five U.S. liquid gallons.

Section 2. That Section 17.08.030, of the Code of The Metropolitan Government of Nashville and Davidson County, District Land Use Tables, is hereby amended as follows:

1. By adding “Artisan distillery” under the industrial land use heading as a permitted (P) use in the CC, CF, IWD, IR and IG zoning districts.
2. By deleting “Microbrewery” under the commercial land use heading.
3. By adding “Microbrewery” under the industrial land use heading.

Section 3. This Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Madam President:

I move to amend Ordinance No. 2009-537 by modifying it as follows:

By adding the following sentence to the definition of “Artisan Distillery” in Section 1:

“No Artisan Distillery shall be permitted within an Adult Entertainment establishment.”
