ORDINANCE NO. BL2009-533

An ordinance authorizing the Director of Public Property, or his designee, to accept and record easements in favor of the Metropolitan Government, for the use and benefit of the Greenway Commission, on certain parcels of property for use in the greenway system (Proposal No. 2009M-081ES-001).

WHEREAS, the owners of the parcels of property shown on the documents attached as Exhibits A through J to this ordinance (the Properties) have agreed to donate to the Metropolitan Government, for the use and benefit of the Greenway Commission, easements on the Properties; and,

WHEREAS, the easements will be used to construct, operate and maintain portions of the greenway system; and,

WHEREAS, it is anticipated that each of the easements will be dedicated with a separate agreement substantially in the form of the document attached as Exhibit K to this ordinance; and,

WHEREAS, the citizens of Nashville and Davidson County will benefit by accepting the donated easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Director of Public Property, or his designee, is authorized to accept and record easements from the owners of the parcels of property shown on Exhibits A through J. Each of the easements shall be dedicated with a separate agreement substantially in the form of Exhibit K.

Section 2. In the alternative, if negotiations relating to acceptance of an easement from the owners of one of the parcels of property shown on Exhibits A through J results in an agreement that is substantially different from the form attached hereto as Exhibit K, such revised agreement may be approved by resolution of the Metropolitan Council.

Section 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
