ORDINANCE NO. BL2009-529

An ordinance approving an amendment and extension of the Recycling Services Agreement between The Metropolitan Government of Nashville and Davidson County and QRS, Inc., formerly Rivergate Recycling.

WHEREAS, The Metropolitan Government of Nashville and Davidson County entered into a Recycling Services Agreement with QRS, Inc., formerly Rivergate Recycling, dated September 8, 2004, attached as Exhibit A; and,

WHEREAS, the parties wish to amend the contract by extending the term of the agreement, which will otherwise expire on November 1, 2009; and,

WHEREAS, the parties also wish to amend the pricing terms for the recycling services rendered by QRS, Inc., as detailed in the Amended Recycling Services Agreement, attached as Exhibit B; and,

WHEREAS, approval of the extension and amendment of the Recycling Services Agreement will preserve the uninterrupted recycling services for the benefit of the citizens of Nashville and Davidson County.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the extension and amendment to the Recycling Services Agreement by and between QRS, Inc., formerly Rivergate Recycling, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Public Works Department, a copy of which amendment and extension are attached hereto and incorporated herein, are hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That any amendment to the Recycling Services Agreement may be approved by resolution of the Metropolitan Council receiving twenty-one (21) votes.

Section 3. That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
