ORDINANCE NO. BL2009-527

An ordinance amending Chapters 15.20 and 15.36 of the Metropolitan Code pertaining to the charging of water and sewer tapping and capacity fees.

WHEREAS, the local and national economy are in the worst recession since the Great Depression; and

WHEREAS, the number of local development projects has dropped considerably over the past year, with many construction workers currently out of a job; and

WHEREAS, in an effort to stimulate the local economy and increase our property tax base, it is in the best interest of the Metropolitan Government to suspend the charging of water and sewer tapping and capacity fees.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 15.20.030 of the Metropolitan Code is amended by adding the following new subsection C.:

“C. Notwithstanding the foregoing provisions of this section to the contrary, the charging of fees for the privilege of tapping or connecting to the water distribution system shall be suspended for a period of three hundred sixty-five (365) days following the effective date of this subsection.”

Section 2. That Section 15.20.045 of the Metropolitan Code is amended by adding the following new subsection D.:

“D. Notwithstanding the foregoing provisions of this section to the contrary, the charging of a capacity charge for connections to the public water supply system shall be suspended for a period of three hundred sixty-five (365) days following the effective date of this subsection.”

Section 3. That Section 15.36.020 of the Metropolitan Code is amended by adding the following new subsection C.:

“C. Notwithstanding the foregoing provisions of this section to the contrary, the charging of fees for connections to the public sanitary sewer system shall be suspended for a period of three hundred sixty-five (365) days following the effective date of this subsection.”

Section 4. That Section 15.36.040 of the Metropolitan Code is amended by adding the following new subsection G.:

“G. Notwithstanding the foregoing provisions of this section to the contrary, the charging of a capacity charge for new connections to the public sanitary sewer system shall be suspended for a period of three hundred sixty-five (365) days following the effective date of this subsection.”

Section 5. This Ordinance shall take effect from and after its enactment, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
