ORDINANCE NO. BL2009-504

An Ordinance approving an agreement between The Metropolitan Government of Nashville and Davidson County and The Land Trust for Tennessee, Incorporated, for The Land Trust to provide planning and management services to enable an Open Space Planning project to be conducted and for the parties to enter into a cost sharing arrangement in connection therewith.

WHEREAS, the State of Tennessee recognizes The Land Trust for Tennessee, Incorporated (“The Land Trust”) as a 501(c)(3) organization whose purpose is to promote for the benefit of the general public the preservation and enhancement of natural and cultural resources principally in the State of Tennessee, and as such has the leadership and capacity to lead an Open Space Planning project; and,

WHEREAS, The Metropolitan Government of Nashville and Davidson County (“the Metropolitan Government”) has identified the need for the planning and management assistance as described in Appendix A to the attached “Project Cooperation Agreement for Management of a Davidson County Open Space Plan between The Land Trust for Tennessee, Inc. and The Metropolitan Government of Nashville and Davidson County” (the “Project Cooperation Agreement”); and,

WHEREAS, the Metropolitan Government has the authority and capability to furnish the cooperation set forth in the Project Cooperation Agreement and is willing to participate in project cost-sharing in accordance with the terms of the Project Cooperation Agreement; and,

WHEREAS, the Project Cooperation Agreement calls for the Metropolitan Government to contribute 55% of the funding for the project, not to exceed a total contribution of $151,250.00; and,

WHEREAS, the overall cost of the project, including the amount to be contributed by The Land Trust toward that cost, is estimated to be $275,000.00; and,

WHEREAS, it is to the benefit the citizens of

The Metropolitan Government of Nashville and Davidson County that the Project Cooperation Agreement be approved.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the “Project Cooperation Agreement, for Management of a Davidson County Open Space Plan between The Land Trust for Tennessee, Inc. and The Metropolitan Government of Nashville and Davidson County,” which Project Cooperation Agreement is attached hereto and made a part of this ordinance, be and the same is hereby approved and the Metropolitan Mayor is authorized to execute the Project Cooperation Agreement on behalf of the Metropolitan Government.

Section 2. That matching funds not to exceed One Hundred and Fifty-One Thousand, Two Hundred and Fifty Dollars ($151,250.00) are hereby approved.

Section 3. That any amendment to the Project Cooperation Agreement may be approved by resolution of the Metropolitan Council receiving twenty-one (21) votes.

Section 4. That this ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
