ORDINANCE NO. BL2009-498

An ordinance amending Section 11.12.070 of the Metropolitan Code regarding noise from commercial establishments contiguous to residential areas.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 11.12.070 of the Metropolitan Code is amended by amending subsection A. by adding the following provision at the end thereof:

“4. Operate or allow the operation of any sound amplification equipment mounted to the exterior of a building or structure, or to operate such device outside of the premises, between the hours of nine p.m. and seven a.m. if such building or structure is located within fifty linear feet from a residentially occupied property.”

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
