ORDINANCE NO. BL2009-497

An ordinance abandoning easement rights within the Old 11th Avenue Right-of-Way through Map 093-09, Parcel 334.00 and Map 093-09, Parcel 333.00 as created by Bill Number BL2006-930 in connection with Project 09-AB-0001, Pine Street Abandonment and authorizing the execution of the documents to carry out said transaction (Proposal No. 2009M-045ES-001).

WHEREAS, easement rights within the Old 11th Avenue Right-of-Way through Map 093-09, Parcel 334.00 and Map 093-09, Parcel 333.00, more particularly described in Project No. 09-AB-0001, Pine Street Abandonment, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2009M-045ES-001 on May 13, 2009 for abandonment of said easement rights.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government hereby abandons the easement rights, shown on Map 093-09, Parcel 334.00 and Map 093-09, Parcel 333.00, Project No. 09-AB-0001, Pine Street Abandonment as indicated on Exhibit 1 hereto.

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
