ORDINANCE NO. BL2009-496

An ordinance abandoning a 10 foot public utility drainage easement in connection with Project 09-D-00029, 8212 Ramstone Way, shown on Map 182-06-A, Parcel 173.00CO and authorizing the execution of the documents to carry out said transaction (Proposal No. 2009M-037ES-001).

WHEREAS, a 10 foot existing public utility and drainage easement, more particularly described in Project No. 09-D-00029 8212 Ramstone Way Abandonment, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2009M-037ES-001 on April 24, 2009 for abandonment of said public utility and drainage easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government hereby abandons the public utility and drainage easement, shown on Map 182-06-A, Parcel 173.00CO, Project No. 09-D-00029, 8212 Ramstone Way as indicated on Exhibit 1 hereto.

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
