ORDINANCE NO. BL2009-493

An ordinance approving an agreement between the Metropolitan Government and Summerfield Village, LLP pertaining to funding for storm water infrastructure improvements near Summercrest Boulevard and Murfreesboro Road.

WHEREAS, pursuant to the terms of the document (the “Agreement”) attached to this ordinance as Exhibit 1, Summerfield Village, LLP (“Summerfield”) proposes to pay $182,000 to the Metropolitan Government for use in constructing storm water infrastructure improvements in the vicinity of a parcel of property (the “Property”) Summerfield is developing; and

WHEREAS, pursuant to the Agreement, the Metropolitan Government will review the status of Summerfield’s compliance with performance agreements and bonding requirements related to development of the Property and revise Summerfield’s obligations under those agreements as appropriate; and
WHEREAS, approval of the Agreement is in the best interest of the Metropolitan Government.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Agreement (Exhibit 1) is approved for execution by the Metropolitan Government officials indicated in the Agreement.

Section 2. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
