ORDINANCE NO. BL2009-488

An ordinance approving an amendment to the Intergovernmental Agreement between The Metropolitan Government of Nashville and Davidson County and the Hospital Authority of The Metropolitan Government of Nashville and Davidson County.

WHEREAS, pursuant to the terms of the attached as Exhibit A and incorporated by reference, The Metropolitan Government of Nashville and Davidson County (the “Metropolitan Government”) and the Hospital Authority of the Metropolitan Government (the “Hospital Authority) created by Ordinance 99-1577, and Resolutions SR99-1410, and R99-1411 through R99-1413 of the Metropolitan Council propose to amend the Intergovernmental Agreement to reduce the required policy limits of the commercial general liability insurance policy and professional liability insurance policy (the “policies”) the Metropolitan Government is required to purchase on behalf of the Hospital Authority out of funds appropriated to the Hospital Authority; and

WHEREAS, the parties desire to add the Bordeaux Long Term Care, J.B. Knowles Home and the Hospital Authority Clinic to the policies; and

WHEREAS, the Board of Trustees of the Hospital Authority approved the proposed amendment on April 6, 2009.

NOW, THEREFORE, be it enacted by the Metropolitan Council of The Metropolitan Government of Nashville and Davidson County;

Section 1. That the amendment to the Intergovernmental Agreement between The Metropolitan Government and the Hospital Authority, attached hereto as Exhibit A, is hereby approved and the Mayor of the Metropolitan Government is hereby authorized to execute the same on behalf of the Metropolitan Government.

Section 2. The officers of the Metropolitan Government are authorized and directed to do all such acts and things and to execute all such documents as may be necessary to carry out and comply with the provisions approved herein.
Section 6. The newly amended Intergovernmental Agreement approved herein may be amended in the future by a resolution of the Metropolitan Council which receives at least twenty-one affirmative votes.

Section 7. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
