ORDINANCE NO. BL2009-485

An ordinance abandoning 1,240 feet of an existing 8 inch water main and 3 fire hydrants and abandoning 720 feet of an existing 8 inch sewer line and 2 manholes and the respective easements in connection with Project 09-SL-0002 and Project 09-WL-0001, shown on Map 107, Parcels 167, and Parcels 171-174, on Piedmont Natural Gas-Nashville Operations property, and authorizing the execution of the documents to carry out said transaction (Proposal No. 2009M-026ES-02).

WHEREAS, an 8 inch existing water main and 3 fire hydrants and accompanying easement, and an 8 inch sanitary sewer line and 2 manholes and accompanying easement, more particularly described in Project No. 09-SL-0002 and Project 09-WL-0001, Piedmont Natural Gas-Nashville Operations, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and,

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2009M-026ES-02 on March 13, 2009 for abandonment of said water main and 3 fire hydrants and easement, as well as sanitary sewer line and 2 manholes and easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government hereby abandons 1,240 feet of an existing water main and 3 fire hydrants and easement, and the 720 feet of existing 8 inch sewer line and the 2 manholes and easement, shown on Map 107, Parcels 167 and 171-174, Project No. 09-SL-0002 and 09-WL-0001, Piedmont Gas-Nashville Operations as indicated on Exhibit 1 hereto.

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
