ORDINANCE NO. BL2009-478

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, to modify the definitions of “Automobile Repair” and “Automobile Service”, all of which is more particularly described herein (Proposal No. 2009Z-012TX-001).

WHEREAS, businesses reconditioning, repairing, selling, and installing used tires display used tires outdoors on racks or in stacks due to insufficient indoor storage space for their tire inventory and/or to attract the attention of passing motorists;

WHEREAS, these same businesses will use the business’s access driveway or customer parking lot area to recondition, repair, sell, mount, and install used tires for customers;

WHEREAS, it is fitting and proper to classify businesses reconditioning, repairing, selling, mounting, or installing used tires as “Automobile Repair”, and new tire sales and services as “Automobile Service”.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the definition for “Automobile Repair” in Section 17.04.060 (Definitions of General Terms) of the Metropolitan Code is hereby amended by inserting after the phrase “fender straightening or repair,” and before the word “welding”, the following phrase “the reconditioning, repairing, sale, mounting, or installing of any used tires.”

Section 2. That the definition for “Automobile Service” in Section 17.04.060 (Definitions of General Terms) of the Metropolitan Code is hereby amended by inserting after the word “batteries,” and before the phrase “tire services and sales” the following phrase “new”.

Section 3. That this Ordinance shall take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
