ORDINANCE NO. BL2009-455

An ordinance abandoning 181 feet of an existing 8 inch sanitary sewer line and easement and accepting 326 feet of relocated 8 inch sanitary sewer line and easement in connection with Project 09-SL-0004, shown on Map 117-10, Parcel 026.00, 3510 Echo Hill Drive Sewer Relocation and authorizing the execution of the documents to carry out said transaction (Proposal No.2009M-032ES-001).

WHEREAS, an 8 inch existing sanitary sewer line and accompanying easement, more particularly described in Project No. 09-SL-0004, Echo Hill Drive, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2009M-032ES-001 on March 25, 2009 for abandonment of said easement and sanitary sewer line.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government hereby abandons the sanitary sewer line and the easement and accepts a relocated 8 inch sanitary sewer line and easement that are of record by Instrument Number 20090330-0028299 of the R.O.D.C., shown on Map 117-10, Parcel 026.00, Project No. 09-SL-0004, Echo Hill Drive as indicated on Exhibit 1 hereto.

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.
Section 3. Amendments to this legislation shall be approved by resolution.

Section 4: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
