ORDINANCE NO. BL2009-454

An ordinance abandoning a 10 foot public storm drainage easement and accepting a relocated 15 foot public drainage easement in connection Project 09-D-0003, Utopia Avenue, shown on Map 105-16, Parcel 141.00, 2136 Utopia Avenue and authorizing the execution of the documents to carry out said transaction (Proposal No. 2009M-006ES-001).

WHEREAS, a 10 foot existing public drainage easement, more particularly described in Project No. 09-D-0003, 2136 Utopia Avenue, on record in the department of Water and Sewerage Services and incorporated herein by reference, is no longer being used by the Department of Water and Sewerage Services nor any other public utility; and,

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2009M-006ES-001 on January 21, 2009 for abandonment of said public drainage easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government hereby abandons the public drainage easement and accepts a relocated 15 foot public drainage easement that is of record by Instrument Number 20090211-0011788 of the R.O.D.C., shown on Map 105-16, Parcel 141.00, and Project No. 09-D-0003, 2136 Utopia Avenue as indicated on Exhibit 1 hereto.

Section 2 . The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
