ORDINANCE NO. BL2009-453

An ordinance abandoning an 8 inch sanitary sewer line and easement and accepting a relocated 8 inch sanitary sewer line and easement, and 3 manholes in connection Project 08-SL-0093, Hill Center, 6604 and 6616 Charlotte Pike, shown on Map 102, Parcels 33 and 53, and authorizing the execution of the documents to carry out said transaction (Proposal No. 2008M-229U-7).

WHEREAS, an 8 inch existing sanitary sewer line and accompanying easement, more particularly described in Project No. 08-SL-0093, Hill Center, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and,

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2008M-229U-7 on December 11, 2008 for abandonment of said easement and sanitary sewer line.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government hereby abandons the sanitary sewer line and the easement and accepts a relocated 8 inch sanitary sewer line and easement and three manholes that are of record by Instrument Number 200903120022313 of the R.O.D.C., shown on Map 102, Parcels 33 and 53, Project No. 08-SL-0093, Hill Center as indicated on Exhibit 1 hereto.

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
