ORDINANCE NO. BL2009-452

An ordinance abandoning a 10 foot public drainage easement and a 35 foot public drainage easement that will be replaced by a variable width easement as shown on the attached exhibit in connection to Project 09-D-0007, Mid-South Development Corporation, shown on Map 070-12, Parcel 014.00, 100 Athens Way and authorizing the execution of the documents to carry out said transaction (Proposal No. 2009M-007ES-001).

WHEREAS, an 10 foot and a 35 foot public drainage easement, more particularly described in Project No. 09-D-0007, Mid-South Development Corporation, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2009M-007ES-001 on February 4, 2009 for abandonment of said public drainage easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government hereby abandons the 10 foot and the 35 foot public drainage easement and accepts a variable width easement as shown on the attached exhibit that are of record by Instrument Number 20081125-0115464 of the R.O.D.C., shown on Map 070-12, Parcel 014.00, Project No. 09-D-0007, Mid-South Corporation as indicated on Exhibit 1 hereto.

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
