ORDINANCE NO. BL2009-449
An ordinance authorizing the acquisition of property by negotiation or condemnation and acceptance for the purpose of acquiring an easement for use in a public project described in the plans for 241 Haynes Park Drive (Proposal No. 2008M-160U-3).
WHEREAS, grants of certain an easement have been executed by the respective property owner and offered to the Metropolitan Government of Nashville and Davidson County; and,
WHEREAS, this easement is described in the plan for a Project on file with the Department of Water and Sewerage Services, and are located on the property described in Exhibit 1 hereto.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.
Section 1. The Metropolitan Government of Nashville and Davidson County, by and through the Director of Public Property Administration is hereby authorized to accept from the respective property owner certain easements as described in the plans for this Project on file with the Department of Water and Sewerage Services, and located on the property described in Exhibit 1 hereto, which plans and exhibit are incorporated herein.
Section 2. The easement shall be filed in the Office of the Register of Deeds to evidence their acceptance.
Section 3. Amendments to this legislation shall be approved by resolution.
Section 4. This ordinance shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
