ORDINANCE NO. BL2009-443

An ordinance amending Section 2.100.030 of the Metropolitan Code pertaining to the jurisdiction of the Transportation Licensing Commission to regulate certain activity within the area of the Metropolitan Government.

WHEREAS, the Metropolitan Transportation and Licensing Commission has the exclusive jurisdiction under Chapter 2.100 of the Metropolitan Code to license and regulate all vehicles for hire, including, but not limited to, taxicabs, wreckers, sedans, and limousines; and

WHEREAS, the Metropolitan Transportation and Licensing Commission currently licenses and regulates horse drawn carriages pursuant to Chapter 12.54 of the Metropolitan Code; and

WHEREAS, the Metropolitan Council deems it to be necessary for the protection of public safety and welfare to grant the Transportation and Licensing Commission the authority to regulate persons and companies providing booting services within the area of the Metropolitan Government.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 2.100.030 of the Metropolitan Code is hereby amended by deleting the first paragraph in its entirety and substituting in lieu thereof the following new sentence:

“The metropolitan transportation licensing commission shall have exclusive jurisdiction of the licensing and regulation of all vehicles for hire, including, but not limited to, taxicabs, wreckers, sedans, limousines, horse drawn carriages, and persons or businesses engaged in the practice of “booting” vehicles. The metropolitan transportation licensing commission shall constitute the sole administrative agency for the administration of all laws and ordinances relating to the licensing and regulation of vehicles for hire and booting services. For purposes of this chapter, ‘booting’ means to attach any device to a vehicle that prevents the vehicle from being driven.”

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
