ORDINANCE NO. BL2009-438

An ordinance abandoning an 8 inch sanitary sewer line and easement and a manhole and accepting a relocated 8 inch sanitary sewer line and easement and manhole in connection with Project 08-SL-0091, shown on Map 075-14, Parcel 78 and Map 075, Parcels 48 and 49, 4309 and 5309 Weber Road, and 8226 Eva Drive, Alan Estates, and authorizing the execution of the documents to carry out said transaction (Proposal No. 2008M-227G-14).

WHEREAS, an 8 inch existing sanitary sewer line and accompanying easement and manhole, more particularly described in Project No. 08-SL-0091, Alan Estates, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2008M-227G-14 on December 8, 2008 for abandonment of said easement and sanitary sewer line and manhole.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government hereby abandons the sanitary sewer line and the easement and manhole and accepts a relocated 8 inch sanitary sewer line and easement and manhole that are of record by Book 9700, Page 205 of the R.O.D.C., shown on Map 075-14, Parcel 78 and Map 075, Parcels 48 and 49, Project No. 08-SL-0091, Alan Estates as indicated on Exhibit 1 hereto.

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
