ORDINANCE NO. BL2009-417

An ordinance amending Chapter 6.72 of the Metropolitan Code of Laws in its regulation of taxicab companies to require both a physical place of business within Davidson County and twenty-four hour call and dispatch services.

WHEREAS, the provision of safe, efficient, and courteous transportation service is needed for the benefit of the citizens and visitors of the Metropolitan Nashville and Davidson County area; and,

WHEREAS, the regulation of such transportation services is already provided for taxicabs, under the Metropolitan Code of Laws, Chapter 6.72; and,

WHEREAS, the Metropolitan Transportation Licensing Commission approved this amendment to the regulation in its August 2007 meeting; and,

WHEREAS, the public health, safety and welfare may best be ensured through the maintenance of call and dispatch services; and,

WHEREAS, it is in the best interest of the Metropolitan Government to require taxicab companies to maintain a fixed central place of business within the Metropolitan Government area and use a twenty-four hour a day dispatch service as a crucial component of such safe and efficient provision of taxicab service.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Code of Laws, Section 6.72.220(B), is hereby amended. This amended section shall read as follows:

Holders of certificates of public convenience and necessity shall maintain a fixed, central place of business within the metropolitan government area. Such businesses shall also provide service twenty-four hours a day for the purpose of receiving calls and dispatching cabs.

Section 2: This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
