ORDINANCE NO. BL2009-409

An ordinance abandoning an 8 inch water line and easement, and accepting a replacement 8 inch water line and easement, as shown on Map 104-12, Parcels 352 and 353, Project 08-WL-0080, Belmont University School of Pharmacy, 1510 Acklen Avenue and 1515 Wedgewood Avenue and authorizing the execution of any documents needed to execute the abandonment (Proposal No. 2008M-207U-10).

WHEREAS, an 8 inch existing water line and accompanying easement, more particularly described in Project No. 08-WL-0080, Belmont University School of Pharmacy, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2008M-207U-10 on November 17, 2008 for abandonment of said easement and water line.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government hereby abandons the water line and the easement and accepts a replacement 8 inch water line and easement that will be relocated in the right-of-way shown on Map 104-12, Parcels 352 and 353, Project No. 08-WL-0080, Belmont University School of Pharmacy, as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 2. Amendments to this legislation shall be approved by resolution.

Section 3: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
