ORDINANCE NO. BL2009-406

An Ordinance amending Section 12.40.200 of the Metropolitan Code pertaining to the starting of parked vehicles.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 12.40.200 of the Metropolitan Code is hereby amended by designating the existing provisions as subsection A., and adding the following new subsection B.:

“B. Notwithstanding the provisions of subsection A. of this section to the contrary, it shall be lawful to start a vehicle which is stopped, standing or parked on private property and let such vehicle remain idling while unattended when the outside temperature is below forty (40) degrees Fahrenheit.”

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
