ORDINANCE NO. BL2009-377

An ordinance abandoning an 8 inch sanitary sewer line and easement and one manhole and acceptance of a relocated 8 inch sanitary sewer line and easement and two manholes in connection Project 08-SL-0060, House of God-Keith Dominion TR. S., shown on Map 081-14, Parcels 001, 002, and 176, 2719 and 2717 West Heiman Street and authorizing the execution of the documents to carry out said transaction (Proposal No. 2008M-177U-8).

An ordinance abandoning an 8 inch sanitary sewer line and easement and one manhole and acceptance of a relocated 8 inch sanitary sewer line and easement and two manholes in connection Project 08-SL-0060, House of God-Keith Dominion TR. S., shown on Map 081-14, Parcels 001, 002, and 176, 2719 and 2717 West Heiman Street and authorizing the execution of the documents to carry out said transaction (Proposal No. 2008M-177U-8).

WHEREAS, an 8 inch existing sanitary sewer line and accompanying easement and one manhole, more particularly described in Project No. 08-SL-0060, House of God-Keith Dominion TR. S., on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2008M-177U-8 on September 29, 2008 for abandonment of said easement and sanitary sewer line and manhole.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government hereby abandons the sanitary sewer line and the easement and accepts a relocated 8 inch sanitary sewer line and easement and two manholes that are of record by Instrument Number 20080908-0091874 of the R.O.D.C., shown on Map 081-14, Parcels 001, 002, and 176, Project No. 08-SL-0060, House of God-Keith Dominion TR. S., as indicated on Exhibit 1 hereto.

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
