ORDINANCE NO. BL2008-352

An ordinance amending Chapters 15.20 and 15.36 of the Metropolitan Code pertaining to the amount of water and sewer capacity charges.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Chapter 15.20 of the Metropolitan Code is hereby amended by deleting Section 15.20.045 in its entirety.

Section 2. Section 15.36.040 of the Metropolitan Code is hereby amended by deleting the phrase “two thousand dollars”, wherein it appears in subsection A., and substituting in lieu thereof the phrase “five hundred dollars”.

Section 3. Customers currently on a water capacity fee payment plan pursuant to Sections 15.20.050 of the Metropolitan Code shall have the remaining balance under their payment plan forgiven. Customers currently on a sewer capacity fee payment plan pursuant to Section 15.36.070 of the Metropolitan Code that have made payments totaling an amount equal to or exceeding the reduced capacity fee established by this Ordinance shall have the remaining balance under their payment plan forgiven. Customers on a capacity fee payment plan, or those customers that have paid their capacity fees in full as of the effective date of this Ordinance, shall not be entitled to any reimbursement for amounts paid in excess of the reduced capacity fees established pursuant to this Ordinance.

Section 4. This Ordinance shall take effect from and after its enactment, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
