ORDINANCE NO. BL2008-351
An ordinance amending Chapter 12.76 of the Metropolitan Code to provide maintenance standards for bridges owned or maintained by railroad companies.
BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. Chapter 12.76 of the Metropolitan Code is hereby amended by adding the following new Section 12.76.135:
“12.76.135 Maintenance standards for railroad bridges.
All railroad companies owning and/or maintaining bridges within the area of the Metropolitan Government shall keep such bridges in good structural condition. All metal surfaces or such bridges subject to rust or corrosion shall be painted to inhibit such rust and corrosion and all surfaces with rust or corrosion shall be stabilized and painted to inhibit future rust and corrosion.”
Section 2. The Metropolitan Clerk is directed to send a certified copy of this Ordinance to the Commissioner of the Tennessee Department of Transportation, as required by Tennessee Code Annotated § 7-51-801.
Section 3. Pursuant to Tennessee Code Annotated § 7-51-804, the provisions of this Ordinance shall not become effective as to the operation of any train until fifteen (15) days after the service by the Commissioner of the Tennessee Department of Transportation of a copy of the Ordinance upon the registered agent of the railroad operating such train.
Section 4. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
