ORDINANCE NO. BL2008-336

An ordinance abandoning an 8 inch sanitary sewer line and easement and replacing such with an 8 inch sanitary sewer and easement in connection Project 07-SL-0192, 3717 West End Subdivision, shown on Map 104-09, Parcels 180 and 277, 3717 West End Avenue and authorizing the execution of the documents to carry out said transaction (Proposal No. 2008M-114U-10).

WHEREAS, an 8 inch existing sanitary sewer line and easement, more particularly described in Project No. 07-SL-0192, 3717 West End Subdivision, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved mandatory referral No. 2008M-114U-10 on June 11, 2008 for abandonment of said easement and sanitary sewer line, and replacement line and easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government hereby abandons the 8 inch sanitary sewer line and the easement and accepts a replacement 8 inch sanitary sewer line and easement that is of record by Instrument Number 20080519-0051168 of the R.O.D.C. shown on Map 104-09, Parcels 180 and 277, Project No. 07-SL-0192, West End Subdivision, as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 2. Amendments to this legislation shall be approved by resolution.

Section 3: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
