ORDINANCE NO. BL2008-335

An ordinance abandoning an 8” sanitary sewer line and easement and the 10”, 8” and 4” water lines and easements in connection with Project 07-SL-0128 and 07-WL-0080, Carothers Crossing, Phase 3, Section 1, shown on Map 188, Parcels 4, 5, 33, 36, 182, and 183, located at 7156, 7107, 7176, 7140 Carothers Road, authorizing the execution of the documents to carry out said transaction (Proposal No. 2008M-093G-12).

WHEREAS, an 8” sanitary sewer line and easement and the 10”, 8” and 4” water lines and easements, more particularly described in Project No. 07-SL-0128 and 07-WL-0080, Carothers Crossing, Phase 3, Section 1, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2008M-093G-12 on May 28, 2008 for abandonment of said easement and sanitary sewer line and water lines.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government hereby abandons the sanitary sewer line and the easement and water lines and easements shown on Map 188, Parcels 4, 5, 33, 36, 182, and 183, 07-SL-0128 and 07-WL-0080, Carothers Crossing, Phase 3 as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 2. Any further amendments to this Legislation may be processed by Resolution.

Section 3: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
