ORDINANCE NO. BL2008-334

An Ordinance amending Section 17.04.060 of Title 17 of the Metropolitan Code, Zoning Regulations, amending the definition of “automobile repair” and “automobile service” to prohibit vehicles being repaired or serviced from remaining on the premises more than thirty days (Proposal No. 2008Z-091T).

WHEREAS, the definition of “automobile repair” and “automobile service” in Section 17.04.060 of the Metropolitan Code prohibits vehicles being repaired or serviced from remaining on the premises more than 21 days; and

WHEREAS, state law prohibits automobile repair establishments from taking steps toward selling an unclaimed vehicle to recoup the unpaid repair charges until the vehicle has been in the establishment’s possession for 30 days; and

WHEREAS, it is fitting and proper that the definition of “automobile repair” and “automobile service” be amended to correspond with the state law requirements.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 17.04.060 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, is hereby amended as follows:

1. By amending the definition of “automobile repair” by deleting the last sentence in its entirety and substituting in lieu thereof the following new sentence:

“No vehicle to be repaired shall remain on the premises more than thirty days.”

2. By amending the definition of “automobile service” by deleting the last sentence in its entirety and substituting in lieu thereof the following new sentence:

“No vehicle to be serviced shall remain on the premises more than thirty days.”

Section 2. This Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
