ORDINANCE NO. BL2008-303

An ordinance abandoning a 10 inch sanitary sewer line and easement rights and converting same to a Private Service Line easement in connection with Project 08-SL-0054, Bristol Germantown Abandonment, Alley Numbers 221 and 205 associated with Map 082-13, Parcel 203.00, located between Madison and Jefferson Streets and authorizing the execution of the documents to carry out said transaction (Proposal No. 2008M-124U-8).

WHEREAS, a 10 inch existing sanitary sewer line and accompanying easement, more particularly described in Project No. 08-SL-0054, Bristol Germantown Abandonment, on record in the Department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility and may be converted to a private sanitary sewer line; and,

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2008M-124U-8 on June 24, 2008 for abandonment of said easement and sanitary sewer line.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government hereby abandons the 10 inch sanitary sewer line and easement and convert same to a private sanitary sewer line and easement, that is associated with Map 082-13, Parcel 203.00, located in Alley Numbers 221 and 205, Project No. 08-SL-0054, Bristol Germantown Abandonment as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 2. Amendments to this legislation shall be approved by resolution.

Section 3. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
