ORDINANCE NO. BL2008-301

WHEREAS, a 10 foot existing public utility easement, more particularly described in Project No. 08-SG-0055, North Summerfield Drive, on record in the Department of Water and Sewerage Services and incorporated herein by reference, is no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2008M-123G-4 on June 24, 2008 for abandonment of said easement and sanitary sewer line.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government hereby abandons the 10 foot public utility easement shown on Map 042-03, Parcel 118.00, Project No. 08-SG-0055, North Summerfield Drive as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 2. Amendments to this legislation shall be approved by resolution.

Section 3. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
