SUBSTITUTE ORDINANCE NO. BL2008-298

An ordinance amending Section 3.40.050 of the Metropolitan Code to provide a minimum service pension benefit for employees with at least five years credited service from and after September 1, 2005.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Section 3.40.050 of the Metropolitan Code is hereby amended by deleting subsection A. in its entirety and substituting in lieu thereof the following new subsection A.:

"A. The minimum service pension benefit amount shall be applicable to those persons receiving a benefit, as set out below, as of September 1, 2005, or entitled to receive a benefit on or after September 1, 2005, but in either event only to those persons who have completed at least five years of credited service.”

Section 2. Section 3.40.050 of the Metropolitan Code is hereby amended by deleting subsection C. in its entirety and substituting in lieu thereof the following new subsection C.:

“C. The minimum service pension benefit shall be based upon the years of credited employee service under the system and shall be as set out below:
1. For those persons with less than five years of service there is no minimum service pension benefit.
2. For those persons with five years of service but less than six years of credited employee service, the minimum service pension benefit shall be seventy-five dollars.
3. For those persons with six years of service but less than seven years of credited employee service, the minimum service pension benefit shall be ninety dollars.
4. For those persons with seven years of service but less than eight years of credited employee service, the minimum service pension benefit shall be one hundred five dollars.
5. For those persons with eight years of service but less than nine years of credited employee service, the minimum service pension benefit shall be one hundred twenty dollars.
6. For those persons with nine years of service but less than ten years of credited employee service, the minimum service pension benefit shall be one hundred thirty-five dollars.
7. For those persons with ten years of service but less than eleven years of credited employee service, the minimum service pension benefit shall be one hundred fifty dollars.
8. For those persons with eleven years of service but less than twelve years of credited employee service, the minimum service pension benefit shall be one hundred sixty-five dollars.
9. For those persons with twelve years of service but less than thirteen years of credited employee service, the minimum service pension benefit shall be one hundred eighty dollars.
10. For those persons with thirteen years of service but less than fourteen years of credited employee service, the minimum service pension benefit shall be one hundred ninety-five dollars.
11. For those persons with fourteen years of service but less than fifteen years of credited employee service, the minimum service pension benefit shall be two hundred ten dollars.
12. For those persons with fifteen years of service but less than sixteen years of credited employee service, the minimum service pension benefit shall be two hundred twenty-five dollars.
13. For those persons with sixteen years of service but less than seventeen years of credited employee service, the minimum service pension benefit shall be two hundred forty dollars.
14. For those persons with seventeen years of service but less than eighteen years of credited employee service, the minimum service pension benefit shall be two hundred fifty-five dollars.
15. For those persons with eighteen years of service but less than nineteen years of credited employee service, the minimum service pension benefit shall be two hundred seventy dollars.
16. For those persons with nineteen years of service but less than twenty years of credited employee service, the minimum service pension benefit shall be two hundred eighty-five dollars.
17. For those persons with twenty years or more of credited employee service, the minimum service pension benefit shall be three hundred dollars.”

Section 3. Section 3.40.050 of the Metropolitan Code is hereby amended by re-lettering subsection D. as subsection E., and by adding the following new subsection D.:

“D. Notwithstanding the foregoing provisions of this section to the contrary, the minimum service pension benefit shall also be applicable to calculations made under Sections 3.40.041 and 3.40.045 for those persons vested in the pension system whose death occurs prior to such person receiving benefits under Chapters 3.32, 3.33, 3.36 or 3.37. The minimum service pension benefit for calculations made under Sections 3.40.041 and 3.40.045 shall be based upon the years of credited employee service under the system and shall be as set out below:
1. For those persons with less than five years of service there is no minimum service pension benefit.
2. For those persons with five years of service but less than six years of credited employee service, the minimum service pension benefit shall be seventy-five dollars.
3. For those persons with six years of service but less than seven years of credited employee service, the minimum service pension benefit shall be ninety dollars.
4. For those persons with seven years of service but less than eight years of credited employee service, the minimum service pension benefit shall be one hundred five dollars.
5. For those persons with eight years of service but less than nine years of credited employee service, the minimum service pension benefit shall be one hundred twenty dollars.
6. For those persons with nine years of service but less than ten years of credited employee service, the minimum service pension benefit shall be one hundred thirty-five dollars.
7. For those persons with ten years or more of credited employee service, the minimum service pension benefit shall be one hundred fifty dollars.”

Section 4. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
