ORDINANCE NO. BL2008-292

An Ordinance amending Chapter 6.52 of the Metropolitan Code regarding the types of plumbing work for which a plumbers’ license is required, and adding specifications for the three license classifications.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Chapter 6.52 of the Metropolitan Code is hereby amended by deleting the provisions of Section 6.52.010 in their entirety and substituting in lieu thereof the following new provisions:

6.52.010 Classifications--Established.
A. For the purposes of this chapter and Chapters 2.92 and 16.12, every person engaged in the business of plumbing or in the performance of any plumbing work within the metropolitan government area shall be licensed by the board of plumbing examiners and appeals in one of the following classifications:
1. Metropolitan master plumber. Every plumbing business within the area of the metropolitan government must have at least one plumber with one or more of the following licenses: (1) master plumber license issued by the board of plumbing examiners and appeals; (2) a Tennessee Mechanical Contractor (CMC) license; or (3) a Tennessee Mechanical Plumbing Contractor (CMC-A) license;
2. Metropolitan journeyman plumber, which works under the direction of a master plumber;
3. Metropolitan apprentice plumber, which works under the direct supervision of a master or journeyman plumber.
B. For purposes of this chapter, “plumbing work” means the construction, renovation, installation, alteration, extension, removal, reparation, maintenance, or servicing, of any plumbing system.
C. Nothing in this chapter shall apply to plumbing work performed by persons at or in their own residences.

Section 2. That Chapter 6.52 of the Metropolitan Code is hereby amended by deleting the provisions of Section 6.52.030 in their entirety and substituting in lieu thereof the following new provisions:

6.52.030 Examination, licensing and registration required.
It is unlawful for any person to engage in the business of plumbing and/or to do or perform any plumbing work as defined in Section 6.52.010, as a master plumber, journeyman or apprentice plumber, without first having been examined, licensed and registered as such by the board of plumbing examiners and appeals.

Section 3. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Madam President:

I move to amend Ordinance No. BL2008-292 by deleting Section 1 in its entirety and substituting in lieu thereof the following new Section 1:
