ORDINANCE NO. BL2008-285

An Ordinance amending Section 17.40.770 of Title 17 the Metropolitan Code, Zoning Regulations, to waive Board of Zoning Appeals application fees for certain applications filed by Members of Council, all of which is more specifically described herein.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 17.40.770 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, is hereby amended by adding the following new paragraph at the end thereof:

“Notwithstanding the foregoing provisions of this section to the contrary, members of the metropolitan council filing applications with the board of zoning appeals on behalf of their constituents shall not be required to pay an application fee, provided the purpose of the application is not for the benefit of an individual property owner or development.”

Section 2. That this Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Madam President:

I move to amend Ordinance No. BL2008-285 by amending Section 1 by adding the following provision at the end thereof:

“Members of the metropolitan council shall be limited to filing two such applications in each calendar year without paying the application fee.”
