ORDINANCE NO. BL2008-270

An ordinance authorizing the Metropolitan Government to participate with Beazer Homes Corporation to provide public sewer service in Williamson County to Ballenger Farms, Phase 4, Project No. 06-SL-141.

WHEREAS, Pursuant to the terms of the document attached as Exhibit A, Beazer Homes Corporation proposes to provide public sewer service in Williamson County, Tennessee, to a development known as Ballenger Farms, Phase 4, Project No. 06-SL-141; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, has built the Mill Creek Trunk Sewer Project No. 98-SG-13 anticipating participation from developers at $2,000.00 per connection towards the cost of the Project; and

WHEREAS, this Project is deemed to benefit both parties and the general community, and Beazer Homes Corporation agrees to pay an amount not to exceed $208,000.00 for a total of 104 single-family connections.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.
Section 1. The participation agreement (Exhibit A) with Beazer Homes Corporation, to provide public sewer services in Williamson County, Tennessee, to a development known as Ballenger Farms, Phase 4, Project No. 06-SL-141, attached hereto and incorporated herein, is hereby approved, and the Director of Water and Sewer Services is authorized to execute the same.

Section 2. That the $208,000.00 from Beazer Homes Corporation will be deposited as a contribution-in-aid of construction in Water and Sewer Extension and Replacement Fund No. 47335.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
