ORDINANCE NO. BL2008-267

An ordinance abandoning an easement for a 10” Public Utility Drainage, not being used by any public entities in connection with, Project 08-SG-0018, Rosa L. Parks Boulevard Abandonment, shown on Map 081-12, Parcel 444.00, 1320 Rosa L. Parks Boulevard authorizing the execution of such documents needed to carry out said transaction. (Proposal No. 2008M-043U-8).

WHEREAS, a 10” Public Utility Drainage Easement, more particularly described in Project No. 08-SG-0018, Rosa L. Parks Boulevard, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2008M-043U-8 on March 19, 2008 for abandonment of said easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN \GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government hereby abandons the Public Utility Drainage Easement in connection with, Project No. 08-SG-0018, Rosa L. Parks Boulevard Abandonment, as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 2. Further amendments to this legislation may be approved by resolution.

Section 3: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Madam President:

I move to amend Ordinance No. BL2008-267 by deleting the phrase “10” Public Utility Drainage”, wherein it appears in the caption and in the first recital clause, and substituting in lieu thereof the phrase “10-foot Public Utility Drainage”.
