ORDINANCE NO. BL2008-258

An ordinance amending Chapter 16.28 of the Metropolitan Code to impose an additional fee for building permits for construction or demolition projects within historic zoning overlays.

WHEREAS, due to the financial condition of the Metropolitan Government, the Historical Commission and the Historic Zoning Commission, along with the majority of the other Metropolitan Government Departments, incurred a five percent operating budget reduction for fiscal year 2008-2009; and

WHEREAS, the Metropolitan Historic Zoning Commission has experienced an unprecedented growth in the amount of cases to review as a result of the dramatic increase in the number of historic zoning overlays within Nashville; and

WHEREAS, in an effort to provide additional revenue for the Metropolitan Government to help offset the budgetary impact on the Historical Commission staff for review of projects within historic zoning overlays, the Council desires to impose an additional fee upon building and demolition permit applications for properties located within historic overlays.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Section 16.28.110 of the Metropolitan Code is hereby amended by adding the following new subsection I.:

“I. Projects within historic zoning overlays. In addition to the fee schedules established pursuant to this section, there shall be an additional fee of fifty dollars for all applications to construct, alter, repair, enlarge, move or demolish any building or structure located within an adopted historic zoning overlay established pursuant to section 17.36.110 of the metropolitan zoning code.”

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
