ORDINANCE NO. BL2008-254

An ordinance abandoning a 20 foot Public Utility Easement in connection with Project 08-SC-0031, 1707 14th Avenue South, shown on Map 105-05, Parcel 562.00, and authorizing the execution of the documents to carry out said transaction (Proposal No. 2008M-075U-10).

WHEREAS, a 20 foot existing Public Utility Easement, more particularly described in Project No. 08-SC-0031, 1707 14th Avenue South, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2008M-075U-10 on May 14, 2008 for abandonment of said public utility easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government hereby abandons the public utility easement shown on Map 105-05, Parcel 562.00, Project No. 08-SC-0031, 1707 14th Avenue South as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 2. Further amendments to this Legislation may be approved by Resolution.

Section 3: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
