ORDINANCE NO. BL2008-249

An Ordinance amending Section 10.20.300 of the Metropolitan Code increasing the distance from residential structures as it pertains to the prohibition on nighttime dumpster collection.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 10.20.300 of the Metropolitan Code shall be and the same is hereby amended by deleting the phrase “three hundred feet”, wherein it appears in subsection E.1., and substituting in lieu thereof the phrase “one thousand feet”.

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Madam President:

I move to amend Ordinance No. BL2008-249 by deleting Section 1 in its entirety and substituting in lieu thereof the following new Section 1:

“Section 1. That Section 10.20.300 of the Metropolitan Code shall be and the same is hereby amended by deleting subsection E. in its entirety and substituting in lieu thereof the following new subsection E.:

E. Hours of Collection and Dumpster Requirements.
1. For properties within the urban services district, no person shall empty or remove any containers used for the accumulation or handling of garbage or rubbish between the hours of eleven p.m. and seven a.m. when said containers are located within three hundred feet of any building or structure used for residential purposes. Provided, however, the prohibition of such activity shall not be applicable:
a. To the CC and CF zone districts of metropolitan government; or
b. When specifically permitted by the director of the department of public works.
2. For properties within the general services district, no person shall empty or remove any containers used for the accumulation or handling of garbage or rubbish between the hours of eleven p.m. and seven a.m. when said containers are located within one thousand feet of any building or structure used for residential purposes.
3. Any dumpster-type containers located within three hundred feet of any building or structure used for residential purposes must contain:
a. On an outside visible surface of the container, a label that includes, in no smaller that one inch tall letters, the following information:
i. The owner of the container;
ii. A telephone number for the owner of the container; and
iii. The telephone number for the metropolitan department of codes administration.
b. Non-metal lids on the top of the containers.”
