ORDINANCE NO. BL2008-185

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by applying an Urban Design Overlay district to various properties located along Dickerson Pike between 1st Street and Trinity Lane (153.85 acres), to regulate all signage, all of which is described herein (Proposal No. 2008UD-001U-05).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, is hereby amended by changing the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of Title 17 by reference, as follows:

By applying an Urban Design Overlay district to various properties located along Dickerson Pike between 1st Street and Trinity Lane (153.85 acres), to regulate all signage, requested by Councilmember Pam Murray, as being various Property Parcel Nos. as designated on Maps 071-03, 071-07, 071-11, 071-14, 071-15, 082-02, 082-03 and 082-06 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is described by lines, words and figures on the plan that was duly considered by the Planning Commission, and which is on file with the Metropolitan Planning Department and made a part of this ordinance as though copied herein.

Section 2. Be it further enacted, that the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Sheet Nos. 071 and 082 said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

Section 3. Be it further enacted, that this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Amendment No. 1
To
Ordinance No. BL2008-185

Madam President:

I move to amend Ordinance No. BL2008-185 by adding the following new Section 2, and renumbering the remaining sections of the Ordinance accordingly:

“Section 2. Be it further enacted, that the provisions of this section shall take precedence over the provisions contained in the urban design overlay plan approved by this ordinance. In the event there is a conflict between the provisions of this section and the urban design overlay plan, the following provisions of this section shall be controlling:
1. Nothing in the urban design overlay approved by this ordinance shall be deemed to require the removal, rehabilitation or reconstruction of any sign erected as of the date of enactment of this ordinance that is in compliance with the requirements of Chapter 17.32 of the Metropolitan Code. The provisions of the urban design overlay plan shall only apply to new or replacement signage constructed or erected within the designated area.
2. All existing signs that are in compliance with the requirements of Chapter 17.32 shall be allowed, regardless of a change in ownership of the property.
3. The signage on existing pole signs may be changed to accommodate new tenants.
4. Monument signs shall be permitted using a ten foot setback from the right-of-way.
5. Signs painted on roofs shall be permitted provided the signage is consistent with the provisions of the urban design overlay plan governing the number and size of building signs.”

I further move to amend Ordinance No. BL2008-185 by amending the plan that was considered by the Planning Commission, and which is on file with the Metropolitan Planning Department and made a part of this ordinance as though copied herein, by deleting footnote 3 on Page 10 of said plan and replacing it with the following:

“The total area of all building signs shall not exceed the maximum permitted sign area or the percentage of building façade allowed by this table, whichever is less.”
