ORDINANCE NO. BL2008-177

An ordinance approving the acquisition of a right-of-way easement from Benson’s, Inc. (Proposal No. 2008M-025G-14).

WHEREAS, the department of Public Works requires a right-of-way easement in connection with paving work near the intersection of Dodson Chapel Road and Central Pike; and

WHEREAS, the Metropolitan Planning Commission approved this mandatory referral No. 2008M-025G-14 on February 19, 2008, for acquisition of said easement: and

WHEREAS, pursuant to the terms of the document attached as Exhibit 1 and incorporated into this ordinance by reference, the owner of the affected property, Benson’s, Inc., proposes to convey the necessary right-of-way easement to the Metropolitan Government for the sum of one thousand five hundred dollars ($1,500.00); and

WHEREAS, acquisition of the easement contemplated herein is in the best interest of the traveling public and the Metropolitan Government.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: Acquisition of the right-of-way easement contemplated herein pursuant to the terms of Exhibit 1 hereto is hereby approved, and the Director of Public Property or his designee is authorized to purchase and accept the easement in accordance with such terms.

Section 2: This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
