SUBSTITUTE ORDINANCE NO. BL2008-173

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the Planned Unit Development District approved by Ordinance No. BL2005-746, as amended, for property located at 8042, 8050, 8058, and 8100 Highway 100, (10.12 acres), approved for a 3,000 square foot bank, two restaurants totaling 9,300 square feet, 34,500 square feet of retail and 12,000 square feet of office space, to modify the signage provisions, all of which is described herein (Proposal No. 2005P-017G-06).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, is hereby amended by changing the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of Title 17 by reference, as follows:

By amending the Planned Unit Development district for property located at 8042, 8050, 8058, and 8100 Highway 100, (10.12 acres), approved for a 3,000 square foot bank, two restaurants totaling 9,300 square feet, 34,500 square feet retail and 12,000 square feet of office space, as being Property Parcel Nos. 287, 288 as designated on Map 155-12 and Property Parcel No. 53, 52 as designated on Map 156-09 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is described by lines, words and figures on the sketch which is attached hereto and incorporated herein by reference, by deleting condition number 3 included in Section 3 of Ordinance No. BL2005-746, as amended, in its entirety and substituting in lieu thereof the following new condition number 3:
“3. All signs shall be monument type signs, not to exceed 15 feet in height. Monument signage shall be architecturally coordinated with the proposed buildings and comply with the requirements of the zoning administrator. No freestanding signs shall be allowed along Old Harding Pike.”

Section 2. Be it further enacted, that the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Sheet No. 155 and 156 of said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

Section 3. Be it further enacted, that this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
