ORDINANCE NO. BL2008-172

An ordinance authorizing the Department of Water and Sewerage Services to use the Metropolitan Government’s contract with UtiliQuest to comply with Tennessee Code Annotated §65-31-101 et seq. as supported by the attached analysis addressing the applicable provisions of Metro Code of Laws §4.12.095.

WHEREAS, the Metropolitan Department of Water and Sewerage Services has determined that it is more economical to contract for the location of underground utilities required under T.C.A. §65-31-101 et seq. with a company being used by other local utilities; and,

WHEREAS, using a location company allows several major utilities to be located simultaneously, thus reducing the potential for damage to the existing water, sewer and stormwater infrastructure.

NOW, THEREFORE, BE IT ENACCTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: That the Director of the Department of Water and Sewerage Services is hereby authorized to use the existing Metropolitan Government contract with UtiliQuest to provide utility location services for Tennessee One Call System, Inc.

Section 2: That the attached justification analysis required by the Metro Code of Laws §4.12.095(e) show that there are neither existing jobs lost nor employees laid off at the Department of Water and Sewerage Services as a result of contracting this required work.

Section 3: That this ordinance shall take effect upon passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
