ORDINANCE NO. BL2008-168

An Ordinance amending Section 17.40.060 of Title 17 of the Metropolitan Code, Zoning Regulations, to require the written consent of all property owners affected by a zoning change prior to acceptance of an application to amend the official zoning map, all of which is more specifically described herein (Proposal No. 2008Z-031T).

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 17.40.060 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, is hereby amended by amending subsection A. by adding the following provision at the end thereof:

“Further, no application to amend the official zoning map shall be accepted by the planning commission or the metropolitan clerk unless written consent of all property owners of record for the property to be rezoned is submitted with the application. This provision requiring property owner consent may be waived by resolution of the metropolitan council receiving twenty-seven (27) affirmative votes.”

Section 2. That this Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
