ORDINANCE NO. BL2008-164

An ordinance authorizing the Metropolitan Government to participate with Sunset Properties to provide public sewer service in Williamson County, to Sunset Park Subdivision, Project Nos. 06-SL-45 and 06-SL-110.

WHEREAS, Sunset Properties has expressed a desire to provide public sewer service in Williamson County, Tennessee, to a development known as Sunset Park Subdivision, Project Nos. 06-SL-45 and 06-SL-110; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerages, has built the Owl Creek Trunk Sewer Project No. 97-SG-84 anticipating participation from developers at $2,000.00 per connection towards the cost of the Project; and

WHEREAS, this project is deemed to benefit both parties and the general community, and Sunset Properties agrees to pay an amount not to exceed $186,000.00, for 93 single-family home connections.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The participation agreement with Sunset Properties, to provide public sewer services in Williamson County, Tennessee, to a development known as Sunset Park Subdivision, Project Nos. 06-SL-45 and 06-SL-110, attached hereto and incorporated herein, is hereby approved and the Director of Water and Sewerage Services is authorized to execute the same.

SECTION 2. That the 186,000.00 from Sunset Properties will be deposited as a contribution-in-aid of construction in Water and Sewer Extension and Replacement Fund No. 47335, for a total of 93 single-family home connections.

SECTION 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
