ORDINANCE NO. BL2008-163

An ordinance authorizing the Metropolitan Government to participate with B & Y Properties to provide public sewer service in Williamson County, to Britain Downs, Phase 1, Project No. 07-SL-49.

WHEREAS, B & Y Properties has expressed a desire to provide public sewer service in Williamson County, Tennessee, to a development known as Britain Downs, Phase 1, Project No. 07-SL-49; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerages, has built the Mill Creek Trunk Sewer Project No. 98-SG-13 anticipating participation from developers at $2,000.00 per connection towards the cost of the Project; and

WHEREAS, This project is deemed to benefit both parties and the general community, and B & Y Properties agrees to pay an amount not to exceed $84,000.00, for 42 single-family home connections.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The participation agreement with B & Y Properties, to provide public sewer services in Williamson County, Tennessee, to a development known as Britain Downs, Phase 1, Project No. 07-SL49, attached hereto and incorporated herein, is hereby approved and the Director of Water and Sewerage Services is authorized to execute the same.

SECTION 2. That the $84,000.00 from B & Y Properties will be deposited as a contribution-in-aid of construction in Water and Sewer Extension and Replacement Fund No. 47335, for a total of 42 single-family home connections.

SECTION 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
