ORDINANCE NO. BL2008-157

An ordinance abandoning an 8” sanitary sewer line and easement and accepting a replacement 8” sanitary sewer line and easement in connection Project 07-SL-0009, shown on Map 105-14, Parcel 069.00, and 8th Avenue Lofts, 8th Avenue South authorizing the execution of the documents to carry out said transaction. (Proposal No. 2007M-061U-10).

WHEREAS, an 8” existing sanitary sewer line and accompanying easement, more particularly described in Project No. 07-SL-0009, 8th Avenue Lofts, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2007M-061U-10 on April 19, 2007 for abandonment of said easement and sanitary sewer line.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the sanitary sewer line and the easement and accepts a replacement 8” sanitary sewer line and easement that is of record by Instrument Number 20070305-0026833 of the R.O.D.C. shown on Map 105-14, Parcel 069.00, and Project No. 07-SL-0009, 8th Avenue Lofts as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

SECTION 2: Any further amendments to this Legislation may be processed by Resolution.

SECTION 3: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
