ORDINANCE NO. BL2008-156

An ordinance abandoning an 8” water line and easement and accepting a replacement 8” water line and easement, that is shown on Map 131-08, Parcels 018.00 and 112.00, Project 07-WL-0005, Harding Heights, 1120 Glendale Lane and 1118 Granny White Court and authorizing the execution of the documents to carry out said transactions (Proposal No. 2007M-106U-10).

WHEREAS, an 8” existing water line and accompanying easement, more particularly described in Project No. 07-WL-0005, Harding Heights, on record in the Department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2007M-106U-10 on May 29, 2007 for abandonment of said easement and water line.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the water line and the easement and accepts a replacement 8” water line and easement that is of record by Instrument Number 20070522-0061001 of the R.O.D.C. and is shown on Map 131-08, Parcels 018.00 and 112.00, Project No. 07-WL-0005, Harding Heights as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

SECTION 2: Any further amendments to this Legislation may be processed by Resolution.

SECTION 3: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
