ORDINANCE NO. BL2008-150

An Ordinance amending Sections 17.08.030 and 17.16.070.P of Title 17 of the Metropolitan Code, Zoning Regulations, to allow vehicular rental/leasing as a use permitted with conditions in the SCR district, all of which is more specifically described herein (Proposal No. 2008Z-024T).

WHEREAS, Section 17.04.060 of the Metropolitan Zoning Code defines “vehicular rental leasing” as “the rental or leasing of automobiles, motorcycles, recreational vehicles, boats, recreational equipment, and light trucks and vans, including incidental parking and servicing of vehicles for rent or lease” (e.g. rental car agencies); and

WHEREAS, the Shopping Center Regional zoning district (SCR) is intended for high intensity retail, office, and consumer service uses for a regional market area; and

WHEREAS, it is fitting and proper that vehicular rental/leasing be permitted with conditions in the SCR zoning district.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Chapter 17.08 of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, is hereby amended by amending Section 17.08.030, District Land Use Tables, by adding “vehicular rental/leasing” as a use permitted with conditions (PC) in the Shopping Center Regional (SCR) district.

Section 2. That Chapter 17.16 of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, is hereby amended by amending Section 17.16.070.P (Uses Permitted w/ Conditions: Commercial Uses): Vehicular Rental/Leasing in its entirety and insert the following in its place:

Vehicular Rental/Leasing. This use shall be allowed in the SCR district or as provided in an adopted Specific Plan district by the Metro Council. In the SCR district, the use shall be limited to renting and/or leasing passenger automobiles, sport utility vehicles, pick-up trucks (3/4 ton or less), and small cargo vans (gross vehicle weight rating of not more than 8,500 pounds), including incidental parking and servicing of these vehicles for rental or lease. No motorcycle, recreational vehicles, boats, recreational equipment, moving vans or moving trucks shall be rented or leased from the property. In addition, no “Automobile Repair” or “Scrap Operation” activities may occur on-site and no inoperable vehicles shall be stored on the property.

Section 3. That this Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Madam President:

I move to amend Ordinance No. BL2008-152 by amending Section 2 by deleting the definition of Vehicular Rental/Leasing, and substituting in lieu thereof the following new definition:

“Vehicular Rental/Leasing. This use shall be allowed in the SCR district or as provided in an adopted Specific Plan district by the Metro Council. In the SCR district, the use shall be limited to renting and/or leasing passenger automobiles, sport utility vehicles, pick-up trucks (3/4 ton or less), and small cargo work vans and passenger vans (gross vehicle weight rating of not more than 10,000 pounds), including incidental parking and servicing of these vehicles for rental or lease. No motorcycle, recreational vehicles, boats, recreational equipment, moving vans or moving trucks shall be rented or leased from the property. In addition, no “Automobile Repair” or “Scrap Operation” activities may occur on-site and no inoperable vehicles shall be stored on the property.”
