ORDINANCE NO. BL2008-132

An ordinance abandoning an 8” sanitary sewer line and easement and accepting a replacement 8” sanitary sewer line, a 6” water line and a 3” water line, and 10 fire hydrants installed in connection with Project 05-SL-0170 and 05-WL-0191, that is shown on Map 76-1, Parcels 82 and 83, 4826 and Lebanon Pike, Heritage Hills and authorizing the execution of the documents to carry out the abandonment (Proposal No. 2007M-052G-14).

WHEREAS, a 8” existing sanitary sewer line and accompanying easement, that will be replaced by an 8” sanitary sewer line and easement, and the installation of an 8” and 3” water line and 10 fire hydrants installed in connection with Project No. 05-SL-0170 and 05-WL-0191, Heritage Hills, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2007M-052G-14 on April 19, 2007 for abandonment of said easement and sanitary sewer line and installation of water lines and fire hydrants.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the sanitary sewer line and the easement shown on Map 76-1, Parcels 82 and 83, Project No. 05-SL-0170 and 05-WL-0191, Heritage Hills as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

SECTION 2: Any further amendments to this Legislation may be processed by Resolution.

SECTION 3: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Madam President:

I move to amend Ordinance No. BL2008-132 by amending Section 1 as follows:
1. By adding after the phrase “as indicated on Exhibit 1 hereto,” the phrase “and accepts the donation of the replacement sewer line and easement as shown on Exhibit 1,”.

2. By deleting the word “abandonment” and substituting in lieu thereof the work “transactions”.
