ORDINANCE NO. BL2008-130

An ordinance abandoning an 8” sanitary sewer line and easement and accepting a replacement 8” sanitary sewer line and easement in connection with Project 07-SL-0004, Belmont United Methodist Church Expansion, located at 1906 21st Avenue South, 1908 21st Avenue South, 1905 20th Avenue South, and 1901 20th Avenue South, as shown on Map 104-12, Parcels 77, 78, 124, & 126, and authorizing the execution of the documents to carry out said transactions. (Proposal No. 2007M-095U-10).

WHEREAS, an 8” existing sanitary sewer line and accompanying easement, as shown in the document attached as Exhibit 1 and incorporated into this ordinance by reference, and more particularly described in the plans for Project No. 07-SL-0004, Belmont United Methodist Church Expansion, on record in the Department of Water and Sewerage Services, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, Belmont United Methodist Church proposes to donate a replacement 8” sewer line and easement, also shown on the plans for Project No. 07-SL-0004 and on Exhibit 1.

WHEREAS, on May 15, 2007, the Metropolitan Planning Commission approved the transactions contemplated by this ordinance pursuant to mandatory referral No. 2007M-095U-10.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the sanitary sewer line and the easement shown on Map 104-12, Parcels 77, 78, 124, & 126, Project No. 07-SL-0004, Belmont United Methodist Church Expansion, further shown on Exhibit 1 to this ordinance, and accepts the donation of the replacement sewer line and easement also appearing thereon, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the transactions authorized by this ordinance.

SECTION 2: That any amendments to this Legislation may be approved by Resolution.

SECTION 3: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
